Il pourrait ainsi être amené à moduler l’effet de l’annu-lation des arrêtés tarifaires. Dans ce cadre, il est à craindre que les réclamations, déposées postérieurement à la décision d’intervenir, ne soient déclarées irrecevables. Un délai bref pour réclamer une demande de restitution... C’est pourquoi il convient, dès à présent et sans at-tendre la future décision du Conseil d’Etat, de mettre en œuvre des demandes de restitution en vue de sau-vegarder au mieux les droits correspondants. En effet, compte tenu des nouvelles règles de prescrip-tion des actions fondées sur une décision juridiction-nelle de non-conformité, une réclamation ne peut être postérieure de plus de 2 ans au paiement de l’impôt ou de la taxe considérée.Ainsi, une réclamation déposée le 17 février 2014 ne pourra concerner que la CSPE payée postérieurement au 17 fév yrier 2012So you need to get it in quickly.. Gardian Posted April 9, 2014 Share Posted April 9, 2014 It may seem so, but this isn't a completely naive question.Why, if there's been an ECJ judgement to this effect, haven't EDF written to all their customers notifying them and instigating refunds?If you were to say that the average household would be entitled to (say) €200 worth of refund x (say) 20m households, that would be €4bn wouldn't it?Surely this is big news in France, or is it being swept under the carpet? Chancer Posted April 9, 2014 Share Posted April 9, 2014 Why does anyone even think in their wildest dreams that they are going to get a refund?This is France after all.I would not be surprised if La Poste is not behind the implausibly short form letter in order to cop for €5 a pop LRAR charges.Ever known France take any notice of the EU or the ECJ when it doesn't suit them, getting money out of EDF is like getting blood out of a stone, after a year of dispute I finally got some compensation and they also finally did my raccordement en collectif one year late and also the mise en service of the first 2 flats.3 weeks later they broke in while I was still in the land of nod and cut them off without any warning or even leaving an avis de passage to say what they had done, they have not even sent me a contract to sign let alone a bill. Appeals, U-turns, conditions to be discussed, changes of policy, and if and when it comes to anything EDF will have thought of a counter attack.
