Philip Posted April 14, 2015 Share Posted April 14, 2015 I sold a French property in October 2012 and I have recentlybeen made aware that the social charge of over 5000 Eurosis actually illegal and that I should put in a claim to be reimbursed.However I would have to mount a legal challenge as the taxauthorities implemented a cut off date being December 31stthe year following completion date for any claims to be considered.My question is do you know of anyone in a similar position and how are they going about their claim?Many thanks for any help.Philip Link to comment Share on other sites More sharing options...

emu Posted April 29, 2015 Share Posted April 29, 2015 HiI am in a similar situation having sold a property in 2013, I have been looking on the internet and forums for help and have found a template of a letter to send to the Centre des Impots for non residents. JohnFB Posted April 29, 2015 Share Posted April 29, 2015 My brother was in a similar situation and reclaimed social charges on a property disposal gain under the terms of the french/swiss tax treaty. He took it all the way thro the courts and won as have manyy swiss, The court ordered the fisc to repay him the charges. Two years later he is still waiting, At each contact they assure they will pay. If the tax authorities do not obey the law, why should anyone else.
