RMI question

I have gathered so much info from this forum over the last few months, thank you all.

I need specific help and I cannot seem to find it with the search facility.

For reasons involving an ex-wife and 2 children, my husband has returned to the UK and has now indicated he will not be returning to France.

I have to think of how I am going to organise my finances.

Because of the vindictiveness of the ex, the house and everything else in France is in my sole name and I have ploughed everything I had into it. He was the earning one and although we managed to get some income from summer rental, no income is foreseen in the short or medium term.

I still have some money left to see me through for a few months after paying the taxes and insurances but the prospect of any kind of job is remote in these parts.

I have registered with temping agencies so I am hoping to get some occasional work from them.

I cannot afford or want to return to the UK.

I understand I might be able to claim for RMI. I also understand this would be short term only, which (along with my savings and some temping work) would see me through until the rental season starts again.

Having downloaded the form, I see there is a section about savings.

Does anyone know what ceiling of savings is allowed or if I have to be on the actual breadline (i.e. having used up ALL I have) before I can claim?

An owner of my property, can I be made to borrow against it?

I know this is a touchy subject, I am not scrounging, indeed I'd rather have a reason to get out and work, if only to have something else to concentrate on.

You're right this is a touchy subject.

My info is based on reading financial articles...

As I understand it, you have to see the social services to apply. Your Mairie will tell you how to contact them.

The actual decison is made by the Préfecture and the amount allocated is based on the last 3 months of earnings up to a maximum ceiling which varies according to the number of people in the "foyer".

Whatever amount is allocated, it is up to that ceiling and only for a mximum of 3 months, after which period, you have to reapply.

I cannot answer re savings, as this is not something I have looked into.

I feel badly for you Frogg.  You sound as though you have your "wits" about you and I am confident you will work this out.

I am presuming you are talking divorce.  If so, you really need to know ALL your rights.  I know it might cost a bit, but you should consult an attorney specializing in family law here.  A consultation should not cost a fortune and could well point you in many different (helpful) directions.

Your Notaire may be able to help you with regards to property ownership, forced borrowing, etc.  I am not a fan of Notaires, but in your case, perhaps they can answer your questions with little time taken.

Thank you Clair and Lori for your messages.

Divorce is of course one of the things I will have to deal with.

I can only deal with one major concern at a time right now. I know I will have to face up to that too, but I cannot yet think rationaly about it at the moment.

Being practical and business-like is the only way to deal with this now. No use crying or cursing or blaming anyone. What is done is done.

Even if I consider selling, he comes into it because is seems I cannot sell the marital home without his consent. As the gite is attached, I cannot sell it either, hence the RMI questions.

Where or how can I find out?

Your first port of call is your Assistant Social - you will get their number from your marie.  Make an appointment and when you go, take all of your papers - even your swimming certificates!!  They will want to know about everything - all your income and all your outgoings.  If you have children you will also need to see the CAF as they may be able to help too.  Good luck.
