We jointly own a property with another couple. We both signed a communaute universelle when purchasing the property. Our friends have now decided to get a divorce. The husband wishes to retain their share of the property and his current wife is in agreement and does not want any payment for same as she is receiving the UK property. What is the best way to transfer her share to him?

Welcome to the Forum J&B.  You need to see your notaire but I guess a lot depends upon where your friends are getting their divorce.  If it is in France, then their share of the property could  be subject to the 'separation des biens'.  I hope this works out well for you.

I'm also going for a divorce and because we married in Australia, that's where the divorce is going to be handled.

As for our assets, I am getting the French property, she gets the Australian property (think I made a boob there, it will be far easier to liquidate Aussie property than french, but oh well, the die has been cast).

I went to see a notaire and he told me it will cost me around €2000 to transfer the property in my name only as for some reason the Australian settlement will have to be translated into French and then approved by a French court for it to be transferred into my name.

Typical bureaucracy.

I will be selling the house next year so may not bother with this extreme expense and when it sells, just get the ex to sign the compromis etc and do it that way. Seems a ridiculous expense otherwise. But I am still dwelling on that point.

But that's just my case, see a notaire is the best advice you can get.

In my experience, ex's do not wanna sign away cash when it appears Mr Lionheart so be careful. By the way, didn't Richard the Lionheart have a taste in chaps rather than gels, so which is yours?
