I have managed to find work through a 'Temp' Agency and would like to know what should, or should not, be happening to my CMU cotisations which I am still paying quarterly as well as making payments through my employer. I had hoped that any changes would happen automatically, but it seems not.  Should I contact CPAM/URSSAF to arrange for my quarterly cotisations to be stopped and then rejoin CMU when I no longer have work?   As the work is a only temporary will there be different regulations regarding payments? Any help/advice gratefully received. Kay

Hi Cooperlola As requested here is my info to date:  my CPAM office is Beauvais (60013).  I have lived in France since 1 Jan 2003, enjoyed 2 years cover with an E106, and then became affiliated to the CMU in 2005.  I am an early retiree and rely on a pension from my preious employer.  I do have a pre-existing ALD (RA) and have received 100% cover for this since June 2006. I received two letters (in the same envelope) from CPAM on 15 December.  One (dated 6th) letter telling me how much my cotisation would be for the year from Oct 07 and at the same time informing me that the conditions giving me the right to stay in France had changed, and that I could no longer be affiliated to the CMU.  The second letter (dated 12th) confirmed 'la radiation de l'affiliation au regime general sous critere de residence (CMU de base)' a compter du 1 Avr 08', and gave me two months to contest the decision.   I wrote to contest the decision on 7 Jan 2008 (using your suggested letters as a base for my case) quoting the relevant Securite Social Point d'information.  A couple of days later I received a phone call asking where I had found my information - I had to direct them to the Securite Soc web site!  Needless to say I was informed that I had misunderstood the information given and that it did not apply to me.  I received no written response to this letter. On 21 Jan I wrote again (sending the letter by registered post this time plus copies to CLEISS and CNAMTS), confirming that I was contesting their decision and included a copy of the letter from the Mme Laflandre plus copies of the info from the Service-Public and Sec Social websites.   This time I did get a written acknowledgment of my letter (dated 22 Jan), but as yet have had no confirmation that I can stay affiliated to the CMU. Hope this is the sort of info you need. Thanks for all your hard work on our behalf. Kay  
  5. I have just had my telephone response, which has upset me greatly! I have been informed that the 5-year rule does not apply to me as I have had no 'accident of life', therefore 5 years of uninterrupted residence means nothing.   As regards to being affiliated to the CMU at 23 Nov 2007 - that means absolutely nothing and does not give me the right to continue being affiliated.  In short, I have misunderstood everything that has been written regarding this change in the law. I explained that it would be impossible for me to get insurance to cover a condition that I already have (RA), she did not understand this and has asked that I get a couple of insurance quotes to prove it (to strengthen my case).  The woman who contacted me is being very sympathetic and will put my case forward explaining my position hoping for some jurisprudence  (and 'will pesonally' follow my file and keep me informed of any progress), but doesn't sound too hopeful. Am I the first person to arrive at this stage? Kay

I actually wrote to CPAM contesting their decision, quoting the statement made by Securite sociale on 14 Dec explaining that the new regulations did not apply to people registered with CMU as of 23 Nov, and also included a bit about the 5-year residency rule.  Today I have received a phone call asking me where I found the information because they were unaware of it, and that I had probably misunderstood it.   I have passed on to Beauvais CPAM the address to the French Securite sociale web site and hope for the best!   Kay

I do  not work, but receive a pension (tax paid in UK) from my previous employer.    I have been paying into CMU since Jan 2005 (having used up my 2 years E106 from Jan 2003), and I believe, will be eligible to qualify as a 'permanent ' French resident on1 Jan 2008.  Since June 2006 I receive 100% cover for a long term condition (RA) - this covers medication etc for this condition only.    However, I have today received a letter from CPAM informing me that I will no  longer be able to benefit from CMU after 31.3.08.   I can appeal this decision, but in light of the recent announcement I thought that I would be covered automatically.   My French language skills are a little lacking, can anyone offer advice as to how I can best resolve  my situation?
