Assurance vie- maximum

Should be grateful for help on the following.

Is there a maximum amount (as a percentage of your capital) which you can place in an assurance vie with nominated beneficiaries?

Is the answer to the above different if the assurance vie is taken out prior to arrival in France?

Hi,

   It depends on your family situation. If you have no reserved heirs ie. children or wife you can put as much as you like into assurance vie without any problem, provided you don't give the tax man grounds to think you have done it purely to avoid tax eg; if a month before dying you put all your considerable liquid assets into assurance vie left to your housekeeper/ mistress they  might contest it in court , but it would have to an abnormal type of transaction .

  On the other hand ,where you have reserved heirs ,notaires advise that you do not put more than your quotité disponible into AL for non-heirs, as your heirs could contest the infringement of their rights. This does not prevent you from doing it--certainly if you are all in agreement.

   If you died resident in France I think both the above cautions would apply.

Hi,

     There is no maximum in the tax regulations (subject to my comments about abnormal transactions obviously done to avoid tax). However the taxfree payout to any one beneficiary is limited to 152500€, thereafter there is a tax of 20%-----If the beneficiary is the surviving spouse or PACS partner, there  is no limit to the taxfree amount they can receive.
