jjgibson
Can anyone shed some light on a problem that a friend of ours has? They have made an offer for a property that they really like privately to the owner. The owner has recently accepted a lower offer through an agent and returned the signed contract (more than 7 days) BUT there are two other parties to the sale (step-children) who have not returned their contracts yet. The agent (who my friend has had no dealings) is threatening legal action against the owner. Can the agent do this? Is he within his rights to withdraw from this other sale with no penalty?Any advice would be much appreciated.Jon(44)
BJSLIV
It all depends on what sort of agreement the owner signed with the Estate Agent. If he agreed (Foolishly?) to give the agent exclusive right, then the agent would still expect his fees.
