What's our primary residence?

The impots lady phoned me the other day and asked me this, but did I give her the right answer, I wonder, and what difference will it make?

My son and I are resident/domiciled here in France, in a rented house.

Husband is working and resident/domiciled in England, but kind of no-fixed-abodish, i.e. our UK house is rented out, so he stays with friends, colleagues, mother, etc.

Impots lady seemed sure that because we're not divorced or separated, the French house is our primary residence, i.e. as a family. But is it? I mean, if he's fully resident in England and has paid all his tax PAYE there....

I would agree with impots lady because 2/3's of your family is here, even though in rented accomodation. On the other hand, if it works out cheaper, I would be happy to disagree with her because your husband is the main wage earner.

Are you working? Why did she want to know?

Yes, this sounds correct and I have read it somwhere very recently. I think it must have been in the April LF magazine. Yes, it was, just found it, P73 article by Bill Blevins 'The Rules of Residency'
