Non eu spouse (wife) & UK citizen...... update anyone?

Bonjour mes amis.

I searched but info. may be outdated here.

What is the position for a UK citizen with UK passport, a wife with an NZ passport... vis-a-vis being legally able to work?

 We are coming  to France  as from December..
  environ Bordeaux.....

 I believe I personally  have no problem.. but  the  situation  for my wife is the real question.

I will follow up a few links there.. re the spousal rights  mentioned.. it does not apply to UK  (as below)

Embassies and immigration workers have various responses  (if any) to the issue..

I think I must have seen

earlier here the  plan to go, get a carte de sejour and put my wife on

it..  but then the  Ambassade (in Wellington, NZ ) says get a long stay

visa..  so hopefully they are wrong. This would not allow her to work

anyway.

I will be  working as a buyer's advocate for  property and also  helping with  renovation plans etc. pour les etrangeres..

For UK i think she has to pay 515 pounds and get a  spouse visa.. stay

3 years for UK citizenship.. so perhaps the  regs in France are not  as

easy as the  carte sejour  idea.

This bit is  worth  copying here.. but  still my  issue is the work situation for no EU spouse.....

Currently  I think  a right to be able to work is probably based on  the issue of a work visa...

have some experience of this as my wife is Ukrainian. We spent the last

two years queuing up for Shengen visa's to visit our holiday home in

France and other EU holidays. Not once did any of the embassies think

to mention we did not need a Schengen Visa. Then by chance we heard

about EU legislation that came into force in 2004 allowing free

movement within the EU (no exeptions) for sposes of EU nationals and

their family.

I suggest if anyone is having problems with travel you download a copy of the legislation here - http://www.europa.eu/scadplus/leg/en/lvb/l33152.htm,

copies are also available in French, German etc etc. We printed a copy

in each language and had them ring bound into a folder at the local

stationers.

The first time we arrived in Limoges airport with an expired

Schengen Visa we were pulled to one side, out came the folder, French

page presented to the Douane who stood scratching their heads and we

were duly waived on our way.We have since been all over the EU and

never more of a hold up than this.

Incidentally another point you should be aware of is that you/your

spouse do not have to queue in the non Eu passport holders channel at

immigration in any EU country any more - you can go straight to the EU

channel - where immigration all seem to know about European Parliament and Council Directive 2004/38/EC of 29 April 2004, where as immigration in the NON EU channel seem to have never heard of it.

My husband (SA) and I (UK) came here to live in August 2005.  As a UK citizen you do not need to apply for a visa to stay.  My husband had no problems getting a ten year visa which enables him to have his own business and everything and it was very simple to do.  I suggest when you get to the town you will settle in that you see your local mairie (town hall) and they will tell you everything you need.  My husband got a spouse visa but he is perfectly capable of working with that visa.  There should be no problems - we certainly didn't have any.  Worth being very nice to the Mairie people though as they help with everything from changing your car license papers to sorting out your bins everything..
