selling houses with pools

Recommended Posts

just a bit of info you may be interested in.

we are selling our house with a pool, we have put up a 1.3 fence with self closing gate etc all solid and child proof because we have young children not because of any legal req as we already have an aproved alarm.

When the notiare asked about the pool he asked for the cert that came with the alarm, I did not have the cert to hand but told him the pool was also fenced.  He then informed me that the fence was not approved and i questioned him to how he knew?? (low flying helicopters or ex ray sight i wondered??

He then produced a picture taken buy the guy who came round to do ther termite test of the pool and fencing??

not that i am paronoid but is big brother watching?? the notiare said any houses sold with out an approved method could be fined and he would need the cert before the sale could be completed

just to let you know

That is truely fascinating.

Earlier this year I posted a thread on the role of Notairs and

complianceprior to a sale, only to be shouted down and proved wrong by

others and none other than the Chambre d Notairs. It seems that some

Notairs are taking thier role as Officiers of the State seriously and

ensuring compliance before a sale can proceed where as others,

including the officier from the Chamber regard the matter as 'none of

thier business.'

Could you please post the Department this Notair is in so that we can

start to build a picture of this issue. Personally I think that it will

become very significant in the furture especially now as a protocol for

inspection is being established with the Gendarmes.

I just visited a Couple who has signed for a house 2 days ago which has a Pool with no compliance with security Norm.

The buyers pointed out that there was no compliance on the Pool and the

Notaire is aleged to reply that it was now their problem.

I am shocked that this could be thier attitude rather than to instruct

the seller that thier pool must comply before the sale, as it is the

law for  all pool owners at this time.

Attitudes seems to vary wildly throughout the country from department

to Department. I would be interested to hear from anyone where the

Notaire is taking a stance insisting on compliance prior to the sale

and in which Department.
