My question is just a little different....

We have a french friend who wants to be a consultant - when someone buys a property and needs a series of jobs done - he can advise on prices, firms availability , methods of work and oversee it all etc.

He is very well qualified in all aspects by experience - but in only certain aspects on paper. So ... to set up here he would need to obtain qualifications (those lacking) and then pay to be a member of various professional bodies before starting his business. This is very expensive in France to set up.

He wonders if he can set up a company in UK .. pay his taxes health/pension here. It is the setting up costs he cannot afford.

There is a market for his work - but it is very difficult to meet the french starting requirements Has anyone got any advice?

yes he can. There are a lot of one man(and more) companies being set in the UK by French, German and dutch people due to the cost. In fact following a recent test case. The european court has ruled that the company must be treated as if a company of the state it resides - in terms of company taxes, accounting etc. perviously for example holland had tried to force an dutch resident and owner of a UK company to follow Dutch company law and taxes - this was judged illegal.

From a personal point of view, however, he would still be liable to french taxs. For the Social security not quite sure how this works.

If he operates in France other than on a very temporary basis he will need to set up a subsidiary in France, for which he will work, so he may end up paying social charges etc in France and company taxes in the UK. There are a lot of French companies, employing a large number of French staff, but actually working in London, an arrangement which saves them a lot in charges. If he wants to be based overseas he could benefit in the same way but if he lives in France it will be very difficult to legally stay out of the French system.
