land lease dispute

Hello all,

We are just about to complete on the purchase of our French house,

It is a small farmhouse with 10 acres in 87,

The land is leased to a local farmer, which when we signed the compromis had until April 2006 to run, this was ok because we have plenty of work to do on the house,

when the lease runs out our plan was to renew for land behind house (6 acres), but keep the paddock to the front for ourselves.

we gave this in a list of questions for notaire, but the estate agent told us the lease has been renewed!

Can this be done without our consent?

Has anyone got any advice?

I'm not an expert in French law but I think you will find that once a piece of land has been legally used, leased or otherwise, by a farmer for farming use, it is almost impossible to change the situation without the farmer's agreement. The law always favours the rights of the farmer.

Speak to the notaire directly and ask him to explain the situation to you. Don't trust the agent. Once you know what the situation is, go and have a friendly chat with the farmer and see if you can negotiate something with him. Take a bottle of Pastis with you and introduce yourselves as his new neighbour which will get you off to a good start !
