1. The agreement is here http://www.hmrc.gov.uk/international/isle-of-man-eol.pdf

The new TIEA seems to be pretty sweeping – making all kinds of information available to the UK tax people, provision to allow them to get IoM to gather additional information they may possibly foreseeable require, conduct tax interviews in IoM etc. It's by no means clear, but this may possibly now already been in force as from 29th September.

    http://www.oecd.org/document/43/0,3343,en_2649_33767_41400747_1_1_1_37427,00.html

As I understand it: Tax avoidance is the legal utilization of the tax regime to one's own advantage, in order to reduce the amount of tax that is payable by means that are within the law. By contrast tax evasion is the general term for efforts to not pay taxes by illegal means.

Is anyone up to speed with what's going on here?

I think now I better lose my name and password again for a few months[:D] Mrs MBK

  2.

The Minister went on: ‘However, I am also aware that people both on and off the Island are looking to me for leadership and clarity on the specific actions we intend to take. Therefore I am announcing today that I intend to raise the limit of protection for deposits of individuals to a maximum of 100% of £50,000.

But-Compensation is paid out of levies collected from other banks. Levies are collected at a maximum of £250,000 per bank per year at the moment - if they increase that by the same amount as the increase in coverage (333.33%) then the banks would have to contribute a maximum of £830,000 per year. As there are a limited number of banks which pay levies, it may take many years for compensation to be paid to depositors. So nothing really changes. The goalposts move slightly. Smoke and mirrors.

To make it a significant benefit they'd have to increase the levies by a lot more than 333% and/or offer some Govt assistance to actually make it worthwhile. It will be interesting to see exactly how much the banks have agreed to put the levies up by.

This period will also vary according to when liquidation proceeds are collected from the failed bank and how much is recovered. There is no "standing fund" of compensation (i.e. money is not collected before a bank failure). So unless they increase the levies by at least the same percentage you're possibly in a worse situation than when it was £15k. [blink]

  3. Just very curious as I have yet again met a couple with E121's been here for 7 years and not

registered for tax. In all this must be about the 12th couple we have

come across in the 6 years we have lived here.

Can someone please point out where it does say if you have an E121 due to pension entitlement that to aquire this you must be in the French Tax system. This couple were adamant they did not need to prove this - I cant remember if we did or not have to prove it, yes we are registered before someone shouts!

I am begining to think it is us thats the fool in doing all by the book.

Please can I use this to bump my thread on " being taxed on a life insurance policy" as we would like the interest from it  desperate to know if we are allowed any allowances as we are only a poor pensioner s.No replies to the thread - perhaps I have worded it badly , it was the tears that did it![+o(] Anybody there[Www]MBK

  4. Please , has anyone been through this scenario and can advise on charges and tax allowances  .

Re investing an insurance with profit bond but keeping the interest that was made over the 6 years. This Bond was taken out whilst an offshore resident.

Also, are there any tax allowances as re: the article in the threads for dividens - will the same allowances apply ? I am aware that if u were UK resident each spouse would be allowed £9,000.00 allowance against the capital gain for an international profit Bond. MBK[blink]

  5. Totally confused. New lap top with vista running well. Downloaded new skype last week. (Have  used skype for years with XP on older computer  ) all well then suddenly skype options -video- will not hold" intergrated lap top web cam" as default . Sometimes it starts off OK as default then halfway through call the other person sees us as an avatar even though we have touched nothing!! I then try to alter default web cam but it insist on showing a flippin avatar , driving me potty . Also confused as skype is now showing another version of skype since last week called Beta for windows !! Any ideas please. Could  anyone recomend messenger instead? Mrs MBK
  6.
We researched this in detail when we were about to purchase our house as everyone was advising us to buy "en tontine" however, on further investigation it appears that "en tontine" is more suitable for those with more than one marriage and step children to consider, not something that applied to us. "en tontine" means that when one partner dies the other inherits the property, regardless of dependents, for their lifetime, but does mean you can pay up to 60% in death duties. We are an "original" couple and all the children are our own, so we opted to change our marriage to a communaute unverselle, which means we both own the property in it's entirety, and on the death of the first partner the survivor only pays 1% tax, the majority being paid on the death of the second parent, sorry kids!![6] This however must be done BEFORE you purchase the property.
WRONG in your statement of " BEFORE you purchase property". We were "en tontine" simply because it seemed like a good idea at the time! 4 years  AFTER "tontine " we decide to change to Communaute Unverselle, all done through the Notaire this cost us approx 600 Euro's complete and inc of fees . Simple and painless.[:D] I am aware of an instance where a French man married to an English person had the same done (no problem) but the cost was much more expensive as it has to go before a court -just different procedure if one is a French national.

  7.
Clair, thanks for your reply.  Nope, I have nothing except the message on the screen, so it cna't be the card, either the box or the dish.  I'm unsure what to check next.  Does anyone know a satellite dish engineer or someone who checks these sorts of things, in Dept 47 Lot et Garonne, please?
Fingers crossed nectarine this does the trick! We are in dept 47 same problem 4 days ago, so what we did was -at the buttons  turn off video, turn off tv, unplug out of socket the digibox ( do not turn off digibox on the actual box.) Wait a couple of mins ( in effect so that you lose all signals , especially the weak signal u had that gave u that message). Simply plug back in , put telly on but for us it is less complicated if we leave video off - maybe not for u. Press "TV " on the diddly diddly, then u are asked to press back up, after u will see the TV menu in that time it is making a new search for a strong signal - just wait and when u here music go into menu as normal. Whew, it really works cos u have forced it to find a stronger signal. Good luck . Mrs MBK[:)]

  8.
Just a note about the tax on interest from savings.  The flat rate applied by the bank on many kinds of savings accounts is indeed 16%.

That only applies to OFF SHORE accounts surely and they still have to be notified to the French tax man whether offshore or not
Off shore flat rate in 2006 was 18% steadily rising, at some point 32%. These days it is to no advantage - there is no hiding place ( and quite right).Yes, we declared it in France so as to pay social charges. [:(]errr and we had a reimbursement from France of the 18% we paid! I see no advantage in paying the withholding tax, better to have it paid gross off shore and the lesser tax in France. I can't see the advantage of paying a withholding tax , can you? or  am I missing the plot[:)]
  9. We have just returned from Trésorerie at Agen 47 on another matter but while there asked if they new the official rate to use for the Tax forms to show bank interest -we showed paperwork that made it clear it was Uk bank interest. They also phoned The Impôt for double confirmation as they understood our concern , I have the figure in writing and signed for, there official figure they said to use was 1.36. [:D]
  10. We had a fireplace /woodburner with insert built by an Artisan in  Dec 2005. We failed to put that on our Tax papers in 2006- would I be right in thinking we are too late to put it on this years with all paperwork showing dates etc ? Mrs MBK[:(]
  11. Ron, sorry I did not explain it well. [8-)]The accountant filled it in correctly showing gross figure in TS.

In the column 5, he wrote the net, in column 6 he wrote the %  (18% as it was offshore)the actual figure (sum) that was taken out he wrote into  Column 7 the actual tax paid at source . Then in A wrote what was in 5, B wrote what was in 7, TS wrote what was gross . BG wrote what was in 7. The French Government kindly wrote a cheque for us in August with the figure that was written in 7 (BG).

Because this time 2007-2008  no tax was taken I felt it was wrong to write the gross figure in column 5 when, last year he wrote the net figure – and the column heading says “Montant  Net – so I was arguing with myself “ it says NET not gross” but your reply implies I should ignore the word NET and write the gross figure , and think of the form as a “working out form” , yes , no, have I understood that OK Ron, thank you for your help.[:D]

  12. ooerrr,[8-)] last year we had tax taken out at source on interest- Form 2047 in  IV paragraph B Autres revenus -( had help filling it in from accountant , for this year he advised have it paid gross as we were losing out , would prefer not to spend the pennies on him this year and do it ourselves ) so we opted for gross but I cant for the life of me see where you would put a gross figure ( where we put it last year said NET !!)  in any of the columns we used last year . Do we need to fill in any extra place because its gross - just the "TS". Would be very grateful for advice , thank you.[:)]
  13. I did put a similar query in the " shopping " shopping for a car in Spain , but got no feed back  so I feel like it was a stupid idea. Binned![:$]

So I am following your thread -  we want just a LHD , French reg small car , diesal, second hand no part ex  but will pay in sterling.[:-))]

We followed up 2 adverts in UK for above spec , the cars did not even exist when friends went  to call cold! [:D]

  14. Conclusion-:[:D]They camped again at the Notaires Friday afternoon , at 3.30 he allowed them in and gave them the cheque and told them to get out! They see that the cheque was signed by the notaire it had the date of April11 crossed out and initialed and 18th April put on!

They still have had no paperwork from the Notaire, not even for the termite inspection. They went back to estate agent who speaks English and asked for a written paper to say this money was for the conclusion of the sale and have asked for an itemized bill as they have had no paperwork from estate agent either as of yet. They are not sure what paperwork to expect but feel there should be something. They phoned direct to the termite inspector to ask what he charged - to see if it tallied - it did he charged 650 Euro for a 2 bedroom 3 floor village house , yet her parents 5 bedroom house (enormous in comparison) was charged only 450 Euro. They have now learned theat there is no fixed price for termite inspection , so be aware - shop around!! mother and daughter ask me to say thank you again, they are just so relieved and weary they cant be bothered to complain. [:(]

  15. yes Ron, they have asked the notaire , all but set up camp on the steps. He just repeats that it will arrive soon, he got very shirty!! after 3rd visit.

Just managed to contact a French friend ex estate agent ,who says its illegal for a notaire to continue with a signing if the money was not sent prior , usuall 4 days in the notaires account so as to pay taxes etc, and only then can the money be passed on.

They have just returned from another trip to estate agent they wanted to see dossiere that had the fax that said money was on its way, but surprise , surprise it was taken home by estate agent and not brought back . Do u think the estae agent is using the money for awhile? its getting scary[8-)]

  16. Please is there a kind person out there who could advise our friends- (sadly they speak little or no French -even worse they do not have a computer[8-)]!!

    Buyer agrees price.

    First signing OK.,

On the 11 April at Notaire ( Notaire is actig for both. Notaire is also acting "power of attorney to sign" on behalf of purchaser who cant be there).

The estate agent is also present.

    They ask for signatures .

    They sign .

They are informed by the estate agent after signing in front of notaire that they have received a fax to say the money is on it's way.!!!!!!!!!!!!!!!!!!!!

    All signatures completed.

Today the 17th the money has still not arrived from the would be purchaser!!!!!!!!!!!!!!!!!!!!!!

    What can they do????????

Are they ( our friends) now entitled to the ten thousand euro deposit, because the proposed buyer failed to come up with money?

Is there a legal law that says a time the money should arrive ?

Threy are frightened that they have signed away the house for no money.

They are frantic with worry .[:(]

    How do they proceed?

    Thank you .Mrs MBK
