    Just a quick question for you experts out there I have sold my house at long last and completion date 30th June, I am assuming I will still get the two tax bills oct/nov for this year and I assume I will have to pay them for the full year if so can I get any money back for the 6 months of the year the house isnt mine.

  2. Many thanks for all your advice. It is very difficult for us to find out what is going on as the estate agent seems to ignore our emails and when they do answer they just state it will be next week now due to 'days off in France' . I have asked them for a copy of the contract as we havent even been sent a copy of that after we signed on the 13th April.  There was no mention of a mortgage when we were signing this came later so it will be interesting to see whether it has been noted on the contract.

    The reason we will be out of pocket is because whilst this is going on we can not rent the property out for holiday rentals which we normally have July and August booked up by now and we have in fact had to cancel some bookings for June and also the house is not being advertised so if it falls through we have lost nearly three month of advertising

    I suppose we just have to sit and be patience which is not one of my strong points.

     

  3. We have agreed and sale and signed the compromis 5 weeks ago and buyer has paid his deposit. However since then nothing has happened and buyer is apparently waiting to see if he can get a mortgage and tried several banks. I appreciate things take a while in France and are done different from the uk but

    1. Is is normal for it to take this long just to get a mortgage approved. 2. Whats happens to the deposit if he doesnt get one approved (assume he will just get that back and leave us out of pocket)

    In the contract it states the sale has to be completed by 4th July.

    My feelings are that they are unable to get a mortgage and in the meantime the house isnt being advertised for sale and we will loose all this years holiday rentals as well

    Yes they have been carried out but I have never been asked for payment or seen copies. I received a bill for the water one which I paid for and when I asked the estate agent do we need to pay for the others they said the notaire pays for them ??

    I know I will have to pay for them one way or another but just wondered the easiest way to get a copy. I emailed the etstae agent and asked do I need to go direct to the notaire to obtain them and I never seem to get anyway only that they will email the water one which I havent actually seen yet.

    Can someone advise the procedure for diagnostic reports when selling a house.

    My estate agent had aranged all the reports but I have since cancelled the exclusif mandat with them so not sure whether I can get a copy of them now. I actually paid for the water control one and they say they will forward that one. I havent paid for the others and I have been told that they are paid by the notaire (I assume they deduct this from any sale of the house).

    I have now got someone interested in purchasing the house directly with me but they want to see the reports. Am I entitled to obtain these from estate agent or notaire or will I have to arrnage for these to be carried out again by myself.

     

  6. I am just concerned the buyer may back out and then where does that leave me we have had so many offers and then people back out last minute.

    Would the buyer still have to pay the estate a percentage even if they had nothing to do with them and dealt with me direct. I read up on a Mandat simple and thought it allows you to sell privately but as long the buyer isnt a client of theirs you should be ok. Is this not right ?

    I havent signed a new contract yet

    I signed a contract with an estate agent over 12 months ago now giving them exclusivity, however we have now been approached directly by someone who wants to put an offer in and despite me telling them to go through the estate agent they insist they would prefer to deal direct. They didnt view the house with the estate agents so will I be ok to deal with them direct or will I be breaking any laws.

    I would prefer them to go through estate agent but dont want to lose a chance of a sale after a year on the market. If I can deal with them direct how do I go about taking of the market with the estate agent 

    Any advice is appreciated

    Could anyone work out for me what I would receive in my hand if I sold my french house I have tried so many times to work everything out from advice people having given me and I am tearing my hair out. I have recd an offer of euros 133,000 (which is less the estate agents fees of 13,000) purchase price of house euros 112,000 balance on mortgage euros 89,000, purchase costs approx euros 14,000.

    I live in the uk and have owned the house in France for 5 years now.

    Any help woould be appreciated.

  9. Thanks for info - yes I was working out from balance of mortgage rarther than purchase price so that will make a difference and also like you say the exchange rate its all swings and roundabouts just wish we could afford to keep it to be honest lol

     

  10. Thanks for that I dont think by the time we finish we will have made enough for the Uk tax. From what I understand in simple terms it is sale price less estate agents fees less solicitors fees (from when buying house) less admin fees less balance on mortgage less any improvement receipts and then what ever is left you pay 16% to French tax and then the difference to Uk tax but with uk allowance for both of us we shouldnt have to pay any. It makes you think whether its worth selling by the time you have finished.

    We have had the house five years in July so was hoping a slight reduction then in what we have to pay out in gains

    I have been trying to work out how much we will actually make but its very difficult lol

    I understand I cant offset the interest on the mortgage which is a shame - Have I forgotten anything else

    I,ve read through some previous post but just wanted to clarify as a uk residence and selling our house in France we have to pay 16 % french captial gains but we have had the house for 5 years in July does the capital gains percentage reduce at this stage and if so what to please ??

  12. Is the bill we are paying this dec for this year ? We have our house up for sale so if we were to empty it soon we wouldnt have to pay next year ? What happens if we sell it say in May next year would we still have to pay for the full year next Dec even if it isnt ours
