Taxe Hab to pay or not to pay.......

Bought last April and I have only just paid the vendor my share of the taxe fonc. The house was previously empty and he didn't pay Taxe hab. The vendor reckons I shouldn't pay it either as it is not my primary residence. I have not received anything. Am I sitting on a bombshell? Taxes are not my favourite purchase but I am concerned like death, tax is the only other certainty.

We received a demand when I applied for building works our 'French Doors' . I wrote back with photos of the house as was ( large holes in roof and floor)and saying we staying in local hotel each holiday till house was fit to live in. Vendors had had water and electricity disconnected and argued that house was not fit to live in.  Received letter saying we had two years to finish work but they would then charge.

If house is fit to live in on Jan 1 but is not occupied the owners are liable to pay

"If house is fit to live in on Jan 1 but is not occupied the owners are liable to pay" That is - the owners ON THAT DATE. Taxe Fonciere is split, but Tax Hab is not, so a buyer in April will recieve the rest of the year 'free'!

That isn't the case mikew. The tax authorities will only charge the owner on the 1st of Jan and are not interested in getting any money for that year from anyone else, ie new owner. It is clearly marked on our bills as to who owes them the money.

What then happens between the seller and buyer is up for negociation. And if it isn't in writing then the new owner is under no obligation to make a participation towards the previous owners liabilty. That they do is simple gentillesse. And some people 'split' both bills.

Cookehouse, we don't get the bills until autumn this year, maybe slightly earlier but the earliest they will send them out is late summer and never before then and they are for the person who owes the money. IE the person who lived in / owned the property on the 1st of January and for this year, 2005.
