Well near fosse septique

There seems to be a rule that a fosse must be at least 35 metres away from a well.

We  are in the process of buying a property that has  outbuildings, that we wish to covert to gites, that are much closer than this to a well.

Is it possible to install a  fosse nearer (few metres)  to the well if we ...  a) guarantee NOT to use the well    or  b) fill in the well with , say, ready-mixed  concrete?

I think the 35m rule applies only if the well is actively used for drinking water

I think also if used for any other purpose inside the house, toilets, washing machine etc.

   If  the well is less than 35mtrs away from the filter system (sand filter ) the filter must be placed in a bag and the outlet to be piped  to at least 35 mtrs away
