freddie frog Posted January 17, 2008 Share Posted January 17, 2008 Further to my original post I seem to have won an argument with my local Hotel des Impots - after furnishing them with a copy of my E121 they agree that no CSG or CRDS Charges should have been paid on our pension income. They have helped us fill out a 'reclamation' form which should see a repayment, eventually.It is interesting to note that on our first visit yesterday they were very vague about the subject & the lady said she knew nothing about any EU directive regarding E121 holders not being subject to these payments. We were then asked to furnish a copy of our E121 which fortunately we had & returned today to do battle. It seems the lady had done her homework overnight because this morning she agreed, without question, that due to the E121 we were disqualified from paying CSG & CRDS on our pensions & issued a repayment form for the last tax year.I only mention all this nausea because it may help other like persons on E121's receiving pension payments & being charged CSG & CRDS on them shouldn't be paying. It also seems that you have to present your E121 to your local tax office to stand any chance of not being charged these Social Charges. Mikew Posted January 17, 2008 Share Posted January 17, 2008 FF, is your tax office at Ruffec? I am going thro' the same performance. I had a demand for 2 year's back tax plus interest. After writing and quoting Form 2041GG and the European court ruling and stating that the tax was not imposable as I did not pay French social charges, I have now had a letter asking me to prove that I do not pay same! POssession of an E form only exempts you from 0.5% CRDS on your earned income or pension, you are still liable to pay contributions sociale at a hefty 11% on any unearned income, like savings interest and rent income. The 11% was paid at the normal time with income tax. SD, I followed your previous instructions religously, box TL was left blank. No problem. The letter I received demanded the unpaid half percent CSG/CRDS on the whole of our pension income, because someone noticed box TL was not filled in and thought it should be. freddie frog Posted January 18, 2008 Author Share Posted January 18, 2008 Seems like not entering anything in box TL, as suggested on previous posts, did not a lot for you then!I am beginning to think that some Hotel des Impots staff are unaware of the E121 & its effect on CSG & CRDS. It maybe a simple thing like E121 is mainly a Health entitlement & dealt with by the CPAM, not the local Tax Office.
