Estate Agent fees

Some friends of ours have been looking to move home in France. They have just found out that some other people they know have put their property on the market with a local agent.

Our friends would very much like to buy this property but are not ready to move right now (they have a small business to wind down) - in addition, this property is right at the top of their price range.

They think that the agency has a three month contract for the sale.

Their question is - how long is it after the 3 month contract has expired can they put in an offer on the house without incurring the wrath of the agency?

This is, of course, assuming that the property isn't sold by the agency in the mean time.

Any thoughts?

I'm just in the process of cancelling 5 mandats de vente and found they are not all the same. One says you can't cancel in the first three months, others say they automatically renew every 3 or 6 or 12 months, unless instructed otherwise. All require the completion of a signed form, reg. post.  So don't be too sure the mandat has expired.

If your friends are contemplating a private purchase at a lower price I think some mandats include a clause which bans this for up to 2 years. Read P-D de Rouffignac's reply in the following thread:

PD actually said "Note that even 'mandats simples' can have far-reaching effects, such as not selling privately to a client originally introduced by the agency, sometimes for a period up to 24 months."

A different situation to the OP who appears to have had no contact or connection with the selling agent.

Thanks guys.

As far as I know the sellers put their house on the market with an agent without the potential purchasers knowing about it.

As with alot of this sort of thing I suppose it's a question of reading the small print.
