tenniswitch
If you are not a French tax resident, can you give away a piece of property? Or a share of a piece of property?I don't mean as some kind of tax dodge with an under-the-table payment, I mean as a legitimate gift of real estate. Nick Trollope
Yes you can. But the recipient will need to pay tax and fees at a market value assessed by the Notaire.
tenniswitch
Thanks, Nick.I guess I need to talk with our notaire to see how much that would run.
BJSLIV
You would also be liable for any Capital Gains Tax......Provided that the property has gained since you purchased it!Depending on your age who you are giving it to there could also be a gift tax liability......up to 50%
tenniswitch
I'm thinking the gift tax wouldn't apply as neither the donor or recipient are French tax residents.
