The new tax on second homes would apply to properties owned by people who are not French tax residents.Does the Commission find that the French proposal is in accordance with the EU regulations on non-discrimination between EU citizens?ENE-005459/2011E-005465/2011E-005632/2011P-005781/2011E-005896/2011E-006008/2011E-006038/2011P-006350/2011E-006361/2011Answer given by Mr Šemetaon behalf of the Commission (19.7.2011)Since its publication, the Commission has been monitoring closely developments in the proposed reform of the tax treatment of investments recently presented by the French Government, in particular the proposal for an annual tax on dwellings owned by persons whose tax domicile is not France and whose income from French sources represents less than 75% of their total world income.Since this proposal is still being discussed by the French Parliament, the Commission is unable to take a definitive position.However, the Commission notes that the French Senate, at its sitting on 20 June 2011, proposed three amendments aimed at abolishing the tax provision referred to in the Honourable Members' questions.If necessary, the Commission will not fail to use the instruments at its disposal to ensure that France complies with European law.
