UK tax rebate not enough after FI form sent?

Can those of you who know about HMRC comment on this please?

As has been mentioned a few times in other threads some French tax offices (but not all) will not sign the France individual form until they see that the income  for the year in question has been declared, and any tax due paid.

This creates a delay before the tax code in the UK can be adjusted, with the following result:

In order to collect the tax due on the

OAP, which is paid free of Tax, HMRC adjusts the tax code on my

Government Pension. However my OAP is in fact taxable in France and

not in France, so on Receipt of the France Individual form the code

is altered back and a refund of the tax already paid is given.

I have just received a refund from my

pension provider, but it seems to me that it is only for the overpaid

tax in the current year 2012-2013.

I was 65 during the tax year 2011-1012,

and it is my understanding that the increased personal allowance for

being over 65 should come into effect from the beginning of the tax

year in which one reaches 65, not just from the date of birth.

In the tax Year 2012-2013 I was given

two codes. For the first part of the year 455P, and for the second

part 728P, where as I should have been taxed under 1050P for the whole year  which is the

new code issued now that the France Individual form has been taken

into account.

I should therefore have a rebate of the

tax taken in the year 2011-2012 under the two inappropriate codes as

well as the refund given for the year up to October 2012 which I have

just received.

I have in fact only been refunded the overpaid tax for this financial year

  You are correct, and should email HMRC to that effect.

Thanks. You are just the person to give me the advice I need, and I am glad that you agree with me.

I wonder if other people have had the same experience, or whether it is only Sue and I who have been kept waiting so long.

It is also possible that some have accepted any rebate gratefully without checking ...

I hope that I haven't misunderstood the problem, but I think the answer may be as follows.

The rebate from your pension provider comes as a result of them applying your new 2012/2013 code to your monthly payment. This will have generated an immediate refund.

Your refund for any previous years (in this case just 2011/2012) comes from HMRC. In Mrs G's case, the money hit her bank a/c within 14 days of them making the calculation, but the written advice of the calculation took about a month to turn up (everything seems to come from Southall !!)

Employers implement revised tax code changes as a 1st priority, and so if the timing coincided nicely with your normal payment date, you could well have seen their rebate before anything from HMRC.

If you asked for the HMRC rebate to be paid directly to a UK bank a/c, it should turn up within days. If however you asked for a cheque, that'll take longer to turn up (via Southall). If directly to your French bank a/c in €'s, then I've no idea re the timing.
