The lorry driver who "caused" my accident by propelling a car directly into my path was also not prosecuted (although his insurance is paying) because he couldn't see the car which he hit, even though he pulled out into its path to pass a parked car.  Always take more care with lorries and remember the addage: "if you can't see them, they can't see you" (and that means the driver, of course, not his lorry!)
