Does anyone know?

My friends son who is 18 and working, has just received a summons to go before the tribunal for non payment of phone bills. He took the phone out on abonnement, went over his limit and now can,t  or hasn,t paid the bill(possibly 2) Are the parents liable to pay that bill or will he be made to pay something weekly/monthly? Would be gratefull if anyone has any knowledge of this or could point her in ther right direction to find out. The parents didn,t sign anything or stand guarantor for anything.

This is not professional advice.

As far as I can tell from your post, if he was 18 when he signed the contract, he is totally liable for the debt.

If the debt is <€3800, he'll be at the Tribunal d'Instance and a judje will render his verdict, which cannot be appealed.

If he's found liable for the debt, he'll also be liable for the costs of the summons and the court case.

If he gets a fine and is unable to pay it, he'll probably get a visit from a huissier de justice (court appointed bailiff) who will attempt to recoup the costs by taking and selling his belongings. The onus will be on the parents to prove what belongs to them and not to him (if he lives under their roof).
