Busy Bee Posted October 3, 2007 Share Posted October 3, 2007 Does anyone know what the law is in France, re guardianship of minors. We are a married couple with 2 young children and we know the children will inherit our house if the worst happens but in the event of an accident what actually would happen to the children (the eldest is 3 years old and the second is 10 months). We haven't made a will as the house is our only asset and we know that is enshrined in law - but do we need to appoint someone to take care of them and also to legally represent them. The children were both born here but we don't have any other family living here although we would prefer the children to stay in France if possible.Thank you in advance to anyone who is able to point us in the right direction.Tracy Link to comment Share on other sites More sharing options...
cooperlola Posted October 3, 2007 Share Posted October 3, 2007 There is some mention HERE (on the Notaires' website.)about a "board of guardians" for minors, but not a lot of detail. I would seek a notaire's advice on this, and certainly make a will. It's cheap and easy and you can make proper provision for your children at the same time. Not leaving a will could leave them in limbo whilst things are sorted out - the last thing you want. The same site (if you go back to the home page and click on "Find a Notaire") will give you a link to Notaires in your area, and you can use the same search facility to find an English speaking one, should that be necessary for you. I did actually find something that said a judge would invite both families to a meeting and then the judge would make a decision, so down to the notaire's office it is.
