The roof on that side needs essential repair and we need to gain access via his garden. Yes, of course, we should ask him nicely but relations are a little strained because of his constantly barking dogs. Does anyone know how we stand legally? YCCMB Posted June 22, 2012 Share Posted June 22, 2012 It's not a question of being able to stop you or not: he can't, but nevertheless you will need to obtain his agreement and permission. You can't just march in and get on with it. If your neighbour wants to have you arrange this at his convenience, it's his right. And there may be a question of establishing an "Etat des lieux" before work begins, so that any damage to his property caused by your works falls to you to repair or compensate.If there's a refusal or unreasonable reluctance on the part of your neighbour, and you have to take matters further, then he will lose.
