Cessation of activities

Earlier this year we accepted a devis from a local artisan and with whom we had had previous relationships and all mainly good.

To date he has completed some 50% of the work covered by the devis and came back once to try to resolve a still outstanding problem (minor) but subsequently we have not seen him and this despite going to see him at his home ringing him and his father and passing him in the street when he was driving his van.

Finally met him today and informally when shopping and he admitted that his business has stopped on the 31st July and for a variety of reasons.

He said that he was now embarrassed and that was the reason for him not coming back and since the first of August he was now working as an employee of someone else.

What please do we do?  How about the work that has been completed and indeed the work that remains to be completed.  We do not wish to walk away from this for we have had work done (with some minor problems) and for which we owe some money.

To whom please do we owe the money that is the main consideration for we do not want to pay money to our artisan if there is an order from a Tribunal or whatever and then we are taking money away from creditors and creditors there are!

The outstanding work can obviously be organised elsewhere but we want to play this game and play it absolutely straight.

Can someone please give us advice?

Has he asked for payment/taken a deposit which would represent more than the value of the work he HAS done?

If he has not I would be inclined to speak to him about whether or not he wants payment - did he say he was bankrupt/in debt?

Then find someone else to do the rest.
