permis de construire...HELP

HELP. we bought our home in Dept 21 (NICEY) within 100m of the 'historic status' church but were assured by the agent and Marie that we would be ok with the permis de construire. The Marie were very happy with our application as were the neighbours...but the offices at Chatillion have turned us down. The building consists of a small house(1bed) and small attatched barn. The house was occupied 3years ago and we pay both sets of taxes.

We applied to convert the barn re-jig the house to make a 3 bed house but it has been refused. The Marie wrote on our behalf objecting to the refusal as planning had been given for barns with asbestos roofs within the 100m limit.

We did have 5 velux windows in the roof in our plans, is this the mistake we made as they only give the ruling of 100m as the refusal. Surely as we pay tax on the house part we can do this up and use it. We have been staying in another house owned by a family member and love France, this was our opportunity to have a small place of our own.

We would welcome ANY advise.

The limits regarding proximity to monuments goes much further than 100 metres, so you really are pretty close to the church. They do not like Velux windows, at the Batiments de France, so if you could reduce their number, put them on the side away from the church that might help. However you really need to speak to the DDE and Batiments De France to find out why they have objected. They are often quite helpful, particularly if you show that you want to do the right thing.

As far as simply renovating the inside of the house in concerned they can't object because of the church , its changing the outside that matters.

Show that you are prepared to spend a bit on conservation type work, avoid UPVC,  and are trying to be sympathetic to the setting and you should be able to reach a compromise.

The precedent from the other development is probably of only limited use, as they tend to be less demanding of buildings inintended for agricultural use, they don't want to be seen to be stopping faramers from plying their trade!

Hi, we also live in a preserved area and had one or six planning "issues", how ever all is well now! We had an interview with The architect de batiment de france in Perigueux nervous as hell before hand ( he held our lives in his hands!!)It was very plain sailing and he was very approachable and we got the small changes changed into what he wanted to see with him making sketches and voila we agreed (he is god afterall!!) My point is you should be able to have an appointment with your regional architect ask at the prefecture or sous prefecture what days he is local to you and go and discuss your requirements and he should also be able to tell you where you are going wrong.
