  1. I looked at the Norge and it certainly seems a good buy on paper. However, I then heard a lot of bad things about build quality/reliability and the availability of parts. I went for a Honda CBS 1300  and LOVE IT. I paid £6500.00 new on March 1st - excellent bike and good value in my books. Still each to their own
  2. As far as a Copyright logo is concerned, in UK law (and I beleive French Law) this is irrelevant, as copyright subsists the moment it is written and does not need any claim on it. (It is needed in the USA).

    If the ISP is UK baseed then I would say that the UK would be the correct jurisdiction for any breach of copyright legal action, although it could be quite expensive to bring. You need to look at what are your losses - if substantial, then sue them, if minimal, then write and ask them to desist - I would never recommend litigation (I am a litigation lawyer) but always try to get a reasonable and negotiated conclusion - maybe they did not realise they couldn't explioit your efforts freely?  - just point it out to them and I suspect most people wiould come to a mutually agreeable solution.

  3. Personally I think you are being harsh.

    What would it really cost you to help these people out? Life is not about what you get out of it, or what price you pay, but in relationships.

    If you really could not have helped, well say so and no-one would have thought the worse of you, but, from your postings, I get the impression that it was a matter of inconvenience, not impossibility.

    Actually, you probably think this likewise as, I suspect, you would not have posted unless you felt a little guilty. From your later postings it appears they also help your family out in other ways-  are you trying to be defensive by saying "She does take him shopping occasionally, but only when she is going anyway, so it's hardly a big favour" - and reading between the lines perhaps your OH agrees with me - is there more to this than meets the eye??  

  4. Article 26 of the Brussels Convention on Jurisdiction and Enforcement of Judgments in Civil and Commercial Matters requires all EC Member States to recognise and enforce the Judgments of other Member States.

    There are a few exceptions such as "contrary to public policy", "irreconciable with another Judgment", "Lack of Jurisdiction to make the Judgment" etc.

    You must firstly get leave to register the foreign Judgment by application to the Central Office of the Queens Bench Division of the High Court - (sounds grand but just call them and they will no doubt help).

    After you have leave to register, you must register!!!! - Do this by giving Notice and serving various documents.

    After it is registered, you can use the normal English Courts to enforce.

     

  5. Make sure there si RFU permission in place!!

    1. No constituent body, club, team or player may arrange or fulfil a fixture or series of fixtures outside

    England, Scotland & Wales (“Overseas Tour”) without previously obtaining the consent of the RFU

    council.

    2. In accordance with a ruling of the IRFB, no club, county or constituent body will be permitted to

    arrange fixtures with the national XV of any of the foundation unions of the IRFB.

    3. Applications for permission to play overseas against a club, district or region not affiliated to any of

    the four home unions or being outside their jurisdiction, must comply with the conditions set out in

    the following paragraphs of this regulation.

    B. Outgoing Tours and Matches

    4. Applications to tour overseas should be made if possible at least one month in advance on the official

    application form which is obtained through the appropriate constituent body or direct from the

    Operations Department. When completed, the form will detail the arrangements offered by the club or

    clubs to be played, including the match or matches arranged. After obtaining the approval of the

    constituent body, the completed form should be sent to the Operations Department at the earliest

    possible date.

    5. Each applicant Club must be in membership of the RFU and the proposed host club or clubs must be

    members of their own national rugby union. Each application must be supported by the constituent

    body to which the club is affiliated.

    6. Tours will only be permitted in the close season where the playing season in the overseas country

    concerned differs from that laid down by the RFU.

    7. If permission is granted the following conditions must be observed:

    7.1 No touring team shall consist of more than:

    18 players and 2 officials for one match.

    21 players and 2 officials for two matches.

    26 players and 2 officials for three or more matches.

    7.2 If more players and/or officials are included in the party their expenses must not be a charge

    on the host union club or school.

    8. Within one month of the date of playing the match or the last match of the tour, the official in charge

    of the party shall submit to the RFU a duly vouched statement of accounts of the tour and an official

    report form (Annex B) duly completed together with general comments on the tour.

    C. Insurance*

    9. Tours overseas will not be approved unless travel insurance has been taken out. A “package” cover

    can be issued by the RFU’s insurance brokers when a club advises them of the details and dates of the

    proposed tour and pays the appropriate premium. Details of the cover and benefits are set out in the

    RFU’s overseas tour package.

    D. Disciplinary Procedure

    10. Should a player of a team undertaking a fixture in Europe be ordered from the field during a match,

    the official in charge of the party shall report this fact.

    10.1 If the player is registered and/or under contract to a Premier or National division club, to

    the RFU Disciplinary Officer.

    10.2 In all other cases, to the secretary of his constituent body and to the RFU.

    In all cases within 48 hours of returning to England, giving an account of the incident. Where 10.1

    above applies the player shall be dealt with by the disciplinary panel referred to in paragraph 3 of the

    “Delegation of Powers” on page 8/30 of the RFU Handbook, and in all other cases by the disciplinary

    committee of his constituent body immediately upon receipt of the referee’s report (Law 26 refers).

    Should the referee’s report not be received within 30 days of the player’s return to England, the

    disciplinary hearing shall proceed upon the report of the incident given by the person in charge of the

    party.

    11. Should a player on a tour outside Europe be ordered from the field of play during a match on such a

    tour (subject to the terms of any tour agreement), his case shall be adjudicated upon within two days

    by a committee convened by the union or sub-union, one of whom shall be chairman. The appointed

    committee shall decide upon appropriate punishment for the player and may reach its decision by a

    majority vote. There shall be no right of appeal against any decision by the appointed committee. The

    appointed committee shall have full discretion as to procedure and as to what evidence it may require,

    provided that the player ordered off shall have the right to be heard if he so desires. The chairman

    shall convey the findings to the union concerned.

    E. Incoming Tours and Matches

    12 Clubs wishing to invite teams from outside the four home unions must apply for consent on the

    official application form. In applying for such consent they must comply with the following

    conditions:

    12.1 Each application must normally be made at least three months in advance.

    12.2 The application must be accompanied by a letter of approval from the constituent body to

    which the club is affiliated.

    12.3 Visiting clubs must be in membership with their own national Rugby Union and must have

    written permission from their governing body to tour.

    F Disregard of Directions

    13. The RFU Council shall have the power to suspend any club or player who may disregard its directions

    with regard to a tour or match out of Great Britain and Ireland.

    OVERSEAS VISITS BY PLAYERS, COACHES AND REFEREES

    See regulations 7 and 9 of the IRFB regulations relating to the Game.

    The RFU strongly recommends any player, coach or referee intending to play, coach or referee overseas, particularly

    with invitation teams or at invitation tournaments etc, to check that adequate insurance cover has been effected.

    Firstly, I am sorry that you hope I'm not "coming to live here"  -  I will try to avoid meeting up with you if it helps.

    Secondly -  you say " it is not how it works here, and wishful thinking is not going to change that" - well surely it IS how it works and that is the point of this string - and to call it a "Scam" when it is simply not a scam but is an example of how the system works is using emotive words and strikes me as rather inflamatory.

    As I said, we are all part of the EU - if the system you are complaining of annoys you, then I am sorry, but in my view it appears to be small minded - I repeat - I am very happy for any of my fellow europeans to have any social benefits that (legally) they are entitled to in whatever State of the EU they find themselves in - that is what membership of the Union gives us - Regulation 1408/71 guarantees to EU nationals the social security benefits of the host nation and takes into accouint the contributions made in his/her home state or other members States.

    I cetaily do not suggest in my post that healthcare should be the same in France as in the UK, - quite frankly the needs within one State are not likely to be mirrored in another State so harmonisation of benefts is not on the cards (or even a good idea at the moment) but I do say that the rules of each State apply equally to any citizen of the EU within that State - and to say otherwise is wrong.

    We are part of the EU - lets accept that and revel in its benefits AND in our differences..

     

     

  7. I have to agree with Chris.

    I am a citizen of the UK - paid taxes and at the same time I am part of the EU -   if I go to France and ask for health care if it is needed then I should receive it as my right - by the same token I have no problem in anyone from France coming to the UK who requires the same rights - what is the problem - either we are all part of the EU or we are not - stop whining an whinging and most importantly stop being insular and narrow minded..

  8. My firm (solicitors) have a three day business meeting away each year. We normally stay in a large house or a couple of close houses and I would like to arrange it for Lille or similar for 2006, having been suggesting france for the past 10 years! We are looking to arrive 29th or 30th June and leaving 2nd July 2006.

    Our requirements are sleeping for 8, preferably in seperate rooms, and a room large enough to hold our meetings in each day, so a large dining room or similar is good. Alternatively, a reasonable hotel with meeting room we can also book would be fine.

    In the evenings we would wish to be close to restaurants and bars - we would not wish to drive very far if at all.

    Can anyone recommend anything for us?

  9. As far as the point raised by Baz is concerned, the effect on tourism, I was loooking to go to Lille for a couple of days with some friends, as I regularly do and often about this time of year. We have deceided to leave our trip until such time as the matter has been quietened down. I suspect I am not the only one.

  10. Help - my Rugby club in England is hosting a French Rugby club tour from Meaux this weekend and I will need to introduce our club officials to them.

    However, I can't think of the correct terms in French!!!

    We have a President - I presume he will be "Président" - easy so far.

    But what about the Club Chairman - how should he be introduced?

    And also, the Club Secretary - (the person who is the equvalent of a company secretary, not the person who types up the letters!)

    Any other linguistic tips also gratefully received.

The trouble with just looking at a list of clubs is that you do not know what they are like - are they a "family" club or "professional" - do they have one man and his dog to watch or hundreds - do they welcome visitors to the club house - in short, what level and culture is the particular club you want to go to - you may only want to spectate, but you may want to become part of the club  (nthing better in my view).

    It would be ueseful if a personal experiences of clubs could be posted
